Fr. Lombardi SJ: VatiLeaks charges a step toward transparency

The Holy See released a 35 page document outlining the Vatican magistrates’ charges against Pope Benedict XVI’s former butler. In the document, examining judge Piero Bonnet also names a second suspect in what has familiarly become known as the Vatileaks scandal, Claudio Sciarpelleti, who will stand trial on minor charges of ‘aiding and abetting’ Gabriele after the fact.

Formal Charges - another step towards transparency

The bringing of formal charges in connection with the publication of confidential Vatican documents is not the last word in what are ongoing investigations, nor do they represent a final statement on what this story means and how it developed.

Si riferisce infatti ad un reato specifico e a due persone (una direttamente responsabile e una solo molto indirettamente coinvolta), e non a un complesso più articolato di eventi e relazioni su cui la stessa magistratura e una commissione cardinalizia sono state chiamate a indagare, con competenze specifiche e prospettive diverse.

The formal charges refer to a specific offense and to two persons (one directly responsible and only very indirectly involved). The charge list does not entertain the notion that there might have a more complex confluence of events and relationships – a possibility that the judges and a select committee of cardinals were called to investigate appropriately.

Tuttavia la pubblicazione della sentenza e della requisitoria che l’ha preceduta non vanno sottovalutate, perché sono un passo concreto, compiuto con strumenti e metodi giuridici specifici, per affrontare i problemi con rigore e trasparenza, senza scorciatoie o coperture per quanto benintenzionate.

Nevertheless, publication of the formal indictment is a concrete step to address problems seriously and transparently.

A complete and comprehensive publication, such as that published [Monday] morning, which reserves only the names and surnames of persons to be protected, is a courageous, and rather unusual act, given the Vatican’s usual practices.

La decisione del Papa di incoraggiare il lavoro della magistratura ha un suo valore significativo, di rispetto scrupoloso per la competenza e l’autonomia di questa istituzione, e di fiducia nel contributo che può dare nel difficile e faticoso cammino per cercare la verità e stabilire la giustizia con strumenti umani.

The Pope's decision to encourage the work of the judiciary is significant as well: of scrupulous respect for the competence and autonomy of the judicial institution, and confidence in the contribution it can make the difficult and arduous journey to seek the truth and establish justice with human instruments.

Forse l’avvicinamento è ardito, ma ci viene da pensare che come il confronto con le istituzioni esterne di Moneyval aiuta certamente a crescere nella direzione della trasparenza economica e finanziaria, così il maggiore riconoscimento del ruolo della magistratura può aiutare oggi a crescere nella direzione della trasparenza e della coerenza nel campo della comunicazione e della discussione di altre questioni non strettamente ecclesiastiche.

Perhaps the comparison is bold, but it occurs to me that, similarly to the way in which cooperation with the independent assessors at Moneyval is helping the Vatican to grow in the direction of economic and financial transparency, so might recognition of the role of the judiciary help today to grow in the direction of transparency and consistency in communication - and in the discussion of other issues not strictly ecclesiastical.

Il contributo della magistratura non basta dunque per affrontare l’intera gamma dei problemi, ma è serio e impegnativo, e può far riflettere sotto una nuova angolatura sulla serietà delle questioni della fedeltà alle istituzioni che si servono, del valore della fiducia e della comunicazione confidenziale, della solidarietà e della responsabilità dell’unione nel servizio delle istituzioni.

The judiciary cannot address the full range of problems, but it is making a real and lasting contribution – one that might bring people to reflect in a new way on the seriousness of the issues of loyalty to the institutions that they serve, the values of trust and of confidential communication, of solidarity and of the responsibility for institutional unity.

This, too, is a perspective from which you can read the line that the Holy Father has deliberately taken in establishing concrete goals and methods, in order to provide far-sighted leadership to those who collaborate with his mission, in increasingly effective service to the Church and Gospel.
